Terms of Use

These Terms of Use ("Terms") govern your use of Nowlark, the iOS app and the notification service behind it (together, "Nowlark"), made by Skail Consulting LLC ("we", "us"). By installing or using Nowlark you agree to these Terms. If you do not agree, do not use Nowlark.

1. What Nowlark is#

Nowlark delivers notifications that you, or software you control, send to your own devices through its API. It is for notifying yourself. It is not a service for messaging other people.

2. Licence#

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nowlark on Apple devices you own or control, subject to these Terms and, where it applies, Apple's Usage Rules in the App Store Terms of Service.

3. Your account and keys#

Nowlark has no sign-up. Your account is created on first launch and kept in your iCloud. You are responsible for the security of your Apple Account and of your API keys: anyone holding one of your keys can send notifications to your devices. If a key is exposed, replace or delete it in the app.

4. Free use and the Upgrade Pass#

Nowlark is free to use, with instant notifications, on one device with one API key and 30 days of history.

The Upgrade Pass is optional and sold through the App Store in two forms: a yearly auto-renewable subscription, or a lifetime pass bought once. It adds more devices and keys, longer history (up to 365 days), images and buttons on notifications, your choice of notification tones, and features released while it is active.

The yearly pass:

  • Payment is charged to your Apple Account when you confirm the purchase.
  • Renewal. The subscription renews automatically for another year at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Managing and cancelling. You can manage or cancel the subscription at any time in your device's Settings › [your name] › Subscriptions. Cancelling stops the next renewal; the current period continues until it ends.
  • Refunds are handled by Apple under its policies, at reportaproblem.apple.com.
  • What you keep. Features that were released while your pass was active remain available to you after it ends. Features released after it ends are not included.
  • Price changes follow Apple's rules, including any notice or consent Apple requires.

The lifetime pass is a one-time purchase. It does not renew and is not a subscription. It includes every Upgrade Pass feature, including features released after you buy it, for as long as we offer Nowlark. It is tied to your Apple Account and restored with Restore Purchases. Refunds are handled by Apple, and a refunded lifetime pass stops unlocking features.

5. Acceptable use#

You agree not to:

  • use Nowlark to send unlawful content, or content you have no right to send;
  • use Nowlark to send notifications to people who have not chosen to receive them;
  • try to access another person's account, keys or notifications;
  • interfere with, overload, or try to get around the limits of the service (currently 1,000 notifications per hour per key), or probe it for vulnerabilities without our written permission;
  • resell or provide Nowlark as a service to others without our written permission.

We may limit, suspend or close an account that breaks these rules or puts the service or other users at risk.

6. Your content#

What you send through Nowlark remains yours. You give us permission to store, process and transmit it only as needed to deliver it to your devices and show you its history, as described in the Privacy Policy. You are responsible for what you send. Notification content passes through Apple's Push Notification service, so think before putting a secret in a notification.

Notifications can contain links and images chosen by whoever sent them. We do not control those websites or images and are not responsible for them.

Nowlark can receive notifications from apps that support Prowl's interface. Prowl is a trademark of its owner. Nowlark is not affiliated with, endorsed by or sponsored by Prowl or its owner.

8. Availability, and what not to rely on Nowlark for#

Nowlark depends on Apple's Push Notification service, your devices, their settings and the internet, none of which we control. Notifications can be delayed or not delivered. We do not guarantee that any notification will arrive, or arrive on time, or that the service will be available without interruption.

Do not use Nowlark as the only way you learn about anything where a missed or late alert could cause harm, including medical, safety, security or emergency situations.

9. Disclaimer of warranties#

To the fullest extent permitted by law, Nowlark is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability#

To the fullest extent permitted by law, Skail Consulting LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising from your use of or inability to use Nowlark, including from notifications that were delayed or not delivered. Our total liability for any claim relating to Nowlark is limited to the amount you paid for the Upgrade Pass in the twelve months before the claim, or US$10 if you paid nothing.

Some jurisdictions do not allow these limitations, so some of them may not apply to you.

11. Indemnity#

You agree to indemnify Skail Consulting LLC against claims arising from the content you send through Nowlark or from your breach of these Terms.

12. Changes#

We may update Nowlark and these Terms. If we change these Terms, we will update the effective date above and publish the new version at this address. Continuing to use Nowlark after a change means you accept it.

13. Ending your use#

You can stop using Nowlark at any time and delete your account in Settings › Delete Account. Deleting your account does not cancel an Upgrade Pass subscription; cancel that in your device's Settings as described in section 4. Sections 6 to 11 and 14 to 16 continue after your use ends.

14. Governing law#

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute will be resolved first by good-faith negotiation and, failing that, in the state or federal courts located in Washington, and you consent to their jurisdiction. This does not take away any rights you have under the mandatory consumer laws of the country where you live.

15. Apple#

If you downloaded Nowlark from the App Store:

  • These Terms are between you and Skail Consulting LLC only, not Apple. Apple is not responsible for Nowlark or its content.
  • Apple has no obligation to provide maintenance or support for Nowlark.
  • If Nowlark fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Nowlark.
  • Apple is not responsible for addressing any claims by you or any third party relating to Nowlark, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
  • If a third party claims that Nowlark or your use of it infringes their intellectual property, Skail Consulting LLC, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Apple's Licensed Application End User License Agreement also applies, and where it conflicts with these Terms, these Terms apply to the extent the law allows.

16. General#

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and us about Nowlark. Our not enforcing a right is not a waiver of it.
